Copyright 101: Unmasking the Mystery of Anonymous and Pseudonymous Works

Writer's picture: Amy NAmy N

Ever wonder what happens when a creator wants to stay in the shadows? No, we’re not talking about Batman. We’re talking about authors and artists who create under an anonymous or pseudonymous identity. It's like being a superhero without the cape, but with all the creative flair. Let’s dive into the mysterious world of copyright for these elusive creators.

First, let’s clear up the lingo. An anonymous work is one where the creator's name is nowhere to be found. Think of it as a ghost story where the ghost is the author. On the other hand, a pseudonymous work is created under a fake name – like Mark Twain, whose real name was Samuel Clemens. It's like having a secret identity without the spandex suit.

So, how does copyright work for these masked crusaders of creativity? According to US copyright law, the copyright for anonymous and pseudonymous works lasts for 95 years from the year of its first publication or 120 years from its creation, whichever comes first. This is different from the usual life-plus-70-years rule for works where the author is known.

Imagine if Banksy, the famously elusive street artist, spray-painted a masterpiece on your garage door. Banksy’s real identity is unknown (anonymous), but the artwork is protected by copyright. If Banksy used a pseudonym, say "Brushy McBrushface," the same rules apply.

But who will exercise the rights of our mysterious artists if they stay hidden? It is the author's agent. Usually, they are the persons or entities that legally publish the work, like the publisher, producer, or recording company. This ensures the work is well taken care of and used properly, like a legal guardian for the art.

So, next time you encounter an anonymous blog post or a novel by an author with a quirky pseudonym, remember – they’ve got the copyright game all figured out. They might be hiding their true identity, but their creative rights are out in the open, ready to be defended by their appointed guardian.
